1. Acceptance of Terms

By using the Service, you represent that you are at least 18 years of age or have obtained parental or guardian consent to use the Service. If you are using the Service on behalf of a minor, you agree to supervise their use and accept full responsibility for their compliance with these Terms.

2. Definitions

For the purposes of these Terms:

THE SERVICE IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. Aushadhi Mate is a medicine tracking and reminder tool designed to help families organize health-related information. It does not provide medical advice, and should not be relied upon as the sole basis for making health-related decisions.

3.2 Consult Healthcare Professionals

Always seek the advice of your physician, pharmacist, or other qualified healthcare provider with any questions you may have regarding a medical condition, medication, or treatment. Never disregard professional medical advice or delay in seeking it because of something you have read or accessed through the Service.

3.3 Emergency Situations

If you think you may have a medical emergency, call your doctor, go to the emergency department, or call emergency services immediately. Aushadhi Mate is not intended for use in emergency situations and should not be used to contact emergency services.

3.4 No Doctor-Patient Relationship

Use of the Service does not create a doctor-patient relationship between you and Aushadhi Mate or any healthcare provider. The Service does not replace the relationship between you and your healthcare providers.

4. Service Description

Aushadhi Mate provides the following features:

Medicine tracking and organization for family members
Medication reminder notifications
Storage of prescription and medical record information
Family member profile management

4.1 Reminder Notifications

Reminder notifications are provided as a convenience feature only. We do not guarantee the delivery, timing, or accuracy of reminder notifications. You should not rely solely on the Service for critical medication timing. Factors beyond our control, including but not limited to device settings, network connectivity, operating system limitations, and third-party service interruptions, may affect notification delivery.

5. User Accounts and Registration

5.1 Account Creation

To use certain features of the Service, you must create an Account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

5.2 Phone Number Authentication

We use phone number-based authentication. You are responsible for maintaining the confidentiality of your phone number and device access. You agree to accept responsibility for all activities that occur under your Account.

5.3 Account Security

You must immediately notify us of any unauthorized use of your Account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this security obligation.

6. User Responsibilities

6.1 Accuracy of Information

You are solely responsible for the accuracy, quality, integrity, legality, and appropriateness of all User Content you submit to the Service. You must ensure that all medication information, dosages, schedules, and medical records entered into the Service are accurate and up-to-date.

6.2 Verification with Healthcare Providers

You must verify all medication information with your healthcare provider or pharmacist. Do not rely solely on information stored in the Service for making medical decisions.

6.3 Device and Software Requirements

You are responsible for obtaining and maintaining all devices, software, and internet connectivity necessary to access and use the Service.

7. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

Using the Service for any illegal purpose or in violation of any local, state, national, or international law
Violating or infringing upon the rights of others, including intellectual property rights, privacy rights, or contractual rights
Transmitting any viruses, malware, or other harmful code
Attempting to gain unauthorized access to the Service, other users' accounts, or connected systems
Interfering with or disrupting the Service or servers or networks connected to the Service
Impersonating any person or entity or falsely stating or misrepresenting your affiliation with a person or entity
Using automated systems, bots, or scripts to access or use the Service
Collecting or harvesting any information from the Service or other users
Using the Service to send spam, advertisements, or unsolicited communications
Reverse engineering, decompiling, or attempting to extract source code from the Service

"Aushadhi Mate" and related logos, graphics, and service names are trademarks of Aushadhi Mate. You are not granted any right or license to use these trademarks without our prior written consent.

8.3 License to Use Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial use.

8.4 User Content License

You retain all rights to your User Content. By submitting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your User Content solely for the purpose of providing and improving the Service.

9. Privacy and Data Protection

Upon your request

12.4 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your Account and User Content from our systems. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
Warranties regarding the accuracy, reliability, or availability of the Service
Warranties that the Service will be uninterrupted, secure, or error-free
Warranties regarding the results obtained from use of the Service
Warranties regarding the delivery or accuracy of reminder notifications

No information or advice obtained from us or through the Service shall create any warranty not expressly stated in these Terms.

14. Limitation of Liability

14.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AUSHADHI MATE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of profits, data, use, goodwill, or other intangible losses
Personal injury or property damage of any nature whatsoever
Medical complications or health issues arising from missed medications or incorrect information
Unauthorized access to or use of our servers and/or any Personal Data stored therein
Interruption or cessation of transmission to or from the Service
Bugs, viruses, or other harmful code transmitted to or through the Service
Errors or omissions in any content or for any loss or damage incurred from use of content

14.2 Limitation on Amount

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED RUPEES (₹100), WHICHEVER IS GREATER.

14.3 Basis of the Bargain

The limitations of liability set forth above are fundamental elements of the basis of the bargain between you and us. We would not be able to provide the Service without these limitations.

You agree to defend, indemnify, and hold harmless Aushadhi Mate and its affiliates, officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

Your use or misuse of the Service
Your violation of these Terms
Your violation of any rights of another person or entity
Your User Content
Any medical decisions you make based on or related to use of the Service

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

The Service may contain links to third-party websites, applications, or services that are not owned or controlled by Aushadhi Mate. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites, applications, or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by use of or reliance on any such third-party services.

17. Governing Law and Jurisdiction

17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

17.2 Jurisdiction

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in [Your City], India. You consent to the personal jurisdiction of such courts and waive any objection to the venue of any proceeding in such courts.

18. Dispute Resolution

18.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. We will attempt to resolve the dispute through good faith negotiation within thirty (30) days.

18.2 Arbitration

If informal resolution is unsuccessful, any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English in Pune, India, by a single arbitrator mutually agreed upon by the parties.

19. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of material changes by:

These Terms, together with the Privacy Policy and any other legal notices or agreements published by us on the Service, constitute the entire agreement between you and Aushadhi Mate regarding the Service and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us.

24. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from any cause beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
